The City of New Orleans has been enjoined by the United States District Court for the Eastern District of Louisiana from enforcing the short term rental regulations enacted in Ordinances 29381 and 29382 pending further order of the court (Rec. Doc. 202 Order Granting TRO). The City will comply with this order and to that end will not be accepting any applications for Non-Commercial Short Term Rental licenses (NSTRs), Commercial Short Term Rental licenses (CSTRs), Short Term Rental Operator licenses (OSTRs), identification numbers for non-short term rentals using STR platforms (XSTRs) or Short Term Rental Platform licenses (PSTRs). This includes both new licenses and renewals of existing licenses. We also will not be accepting payment for any licenses for which applicants may have already applied. All license applications already received by the Department will be held while the Temporary Restraining Order is in effect, and should the order be lifted and the ordinance reinstated, no new applications will be required from these applicants.
In accordance with this court order, the application period set for September 1, 2023 through September 7, 2023, and the corresponding lottery set for October 2, 2023, will be canceled.
This order is in effect pending the court's decision as to the constitutionality of the above referenced ordinances. We do not have a date certain as to when such a decision may be rendered, but will provide further updates when we receive additional information from the court.
